Terms of Service

By creating an account, or by using Pop Quiz at all, you agree to these Terms. You also agree to the End User Licence Agreement, which covers the software itself, and you acknowledge the Privacy Policy, which describes what we do with your data. The three documents are meant to be read together; where the Licence and these Terms overlap on how you may use the software, the Licence governs.

If you do not agree, do not create an account. There is no way to use the parts of Pop Quiz that these Terms govern without one.

You must be at least 13 years old. We do not knowingly collect data from children under 13, and if we learn that an account belongs to one we delete it. If you are between 13 and the age of majority where you live, you need your parent or guardian's permission.

One person, one account. You are responsible for everything done through yours, including by anyone you give your password to.

You give us a username, an email address and a display name, and you choose a password (or sign in with Google instead). Keep the password to yourself and tell us at support@popquiz.com if you think someone else has it.

Two things about accounts that are worth knowing before you rely on them:

• Your email has to be verified before you can take quizzes or earn ranking points. We send a code when you sign up. Until you enter it, the account exists but does not score.
• We sign you out after 15 minutes of inactivity, and every session ends after 7 days regardless. This is a security measure, not a limit on use: signing back in costs nothing and work in the quiz builder is saved as you go.

The quizzes you write, the questions, the answers, the explanations, the images you upload and the text on your profile are yours. We do not claim ownership of any of it, and we do not sell it.

We do need permission to run the service, so by publishing or sharing a quiz you grant us a non-exclusive, worldwide, royalty-free licence to store it, copy it, resize its images and display it to the people you made it visible to. That licence exists only so the product can do the thing you asked it to do, it lasts as long as the content is on the platform, and it ends when you delete the content. Two carve-outs, stated plainly because they are the ones that outlive a deletion:

• A quiz somebody has already taken leaves a score behind. Deleting the quiz removes the quiz; the aggregate leaderboard standing it contributed to is not unwound, because doing so would silently rewrite other people's results.
• Backups age out on their own schedule, so content can persist in a backup for a short period after you delete it. It is not served to anyone from there.

You are responsible for having the right to post what you post. Do not upload someone else's copyrighted material as a quiz image or paste a question bank you do not have a licence to. If you believe something on Pop Quiz infringes your copyright, write to support@popquiz.com identifying the work and the quiz, and we will look at it.

Do not:

• Post content that is unlawful, harassing, hateful, sexually explicit, or that targets a person for abuse.
• Impersonate anyone, or pick a username designed to be mistaken for someone else.
• Try to break, overload or get around the security of the service: probing for holes, scraping at volume, evading rate limits, or automating sign-ins.
• Use the service to distribute malware, or to phish for other users' credentials.
• Resell access to Pop Quiz or present it as your own product.

Repeated failed sign-in and sign-up attempts are rate-limited and then blocked for an escalating period. That is automatic and applies to everyone, including when the cause is an honest mistake.

Ranking points (RP) are a score, not a currency. They have no cash value, they cannot be bought, sold or transferred, and we may recalculate them when the formula or a quiz's statistics change. The rules the software applies:

• Authors do not score on their own quizzes. Taking a quiz you wrote is allowed, and it earns you nothing.
• Unverified accounts do not earn RP.
• Only your best attempt at a quiz counts, and it is scaled by how hard that quiz has proven to be and by whether the quiz has enough distinct takers to be measured at all.
• Attempts that look like an author inflating their own quiz's statistics are excluded from the calculation. They are not refused and you are not accused of anything: the attempt is recorded and simply does not feed the quality figures. How that is detected, and why it stores no IP address, is in clause 4 of the Privacy Policy.

Deliberately gaming the ranking, with extra accounts or with automated attempts, is a breach of these Terms and we may reset the affected scores.

Pop Quiz is provided as it is, with no promise of uptime. We may change, add or remove features, and we may take the service down for maintenance. If we discontinue it altogether, we will give you reasonable notice at the email address on your account and a window to export your quizzes.

We may update these Terms. When a change is material we will tell you before it takes effect, by email or in the app. Continuing to use Pop Quiz after that is how you accept the new version; if you would rather not, delete your account.

You can delete your account at any time from your profile settings. Deletion is not immediate: the account is locked straight away and the data is erased after 30 days. The delay is deliberate, because the most common reason an account gets deleted is that somebody else got into it, and for those 30 days a link sent to the address on the account can undo it. After that the erasure is permanent and we cannot bring anything back.

We may suspend or close an account that breaches these Terms. Except where the breach is serious enough that waiting would harm other users or us, we will tell you why and give you a chance to respond first. If we close your account for a reason that is not your fault, you keep the same 30-day window to retrieve your content.

Pop Quiz is provided without warranties of any kind, express or implied, including fitness for a particular purpose. We do not warrant that quiz content is accurate: quizzes are written by users, and a wrong answer key is theirs, not ours.

To the fullest extent the law where you live allows, we are not liable for indirect or consequential loss, for lost data, or for loss of profits or goodwill arising from your use of the service.

Nothing here limits liability that cannot be limited by law. If you are a consumer in the EU or the UK, you keep your statutory rights in full, and nothing in this clause affects them.

These Terms are governed by the law of France, and the courts of France have jurisdiction over any dispute. If you are a consumer, this does not deprive you of the right to bring a claim in the courts of the country where you live.

If any clause here turns out to be unenforceable, the rest stays in force.
